1. Acceptance
These Terms of Service (“Terms”) govern your access to and use of the Next Leads website at nextleadscrm.com and the application at app.nextleadscrm.com (together, the “Service”), operated by Next Leads (“Next Leads”, “we”, “us”). By creating an account, signing in (including with Google) or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company, you confirm that you are authorized to accept these Terms for it, and “you” refers to that company as well.
2. The Service
Next Leads is a customer relationship management (CRM) tool for businesses. It includes a lead finder that searches public business listings on Google Maps, a sales pipeline, follow-ups, clients, services, projects, sales, finance and recurring revenue features, and team collaboration. Some features are available only on certain plans, as described on our pricing section.
3. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Service. The Service is intended for professional and business use.
4. Accounts and security
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your password secure, for all activity under your account, and for the actions of members you invite to your workspace. We recommend enabling two-factor authentication.
- Workspace administrators control who has access to the workspace and its data.
- Tell us immediately at [email protected] if you suspect unauthorized access to your account.
5. Trial, plans and billing
- Free trial: new workspaces get a free trial for the period and number of queries shown on our website, without a credit card. When the trial ends, the lead finder and other paid features are limited until you choose a plan.
- Subscriptions: paid plans are billed monthly in advance, in US dollars, and renew automatically each month until cancelled. Prices and plan limits are shown on our website and inside the Service.
- Payments: checkout and payments are processed by our payment provider, Dodo Payments, which may act as merchant of record and apply its own terms, taxes and currency conversion.
- Queries: each plan includes a monthly number of lead finder queries; unused queries do not roll over. Extra query packs are valid for the month in which they are purchased.
- Cancellation: you can cancel at any time. You keep access to paid features until the end of the period already paid, and no further charges are made.
- Refunds: payments are non-refundable, including for partial months, except where required by applicable law (including consumer protection law) or at our discretion.
- Price changes: we may change prices with at least 30 days' notice. Changes apply from your next billing period after the notice.
- Late or failed payments: if a payment fails, we may limit paid features until the payment is resolved.
6. Acceptable use
You agree not to, and not to allow anyone to:
- use the Service in violation of any law, including data protection laws (such as the LGPD and GDPR), consumer protection laws and anti-spam or telemarketing rules (such as the CAN-SPAM Act and the TCPA);
- send unsolicited bulk messages, harass businesses or people, or contact anyone who has asked not to be contacted;
- resell, publish or redistribute data obtained through the lead finder as a standalone dataset, or use it to build a competing database or service;
- scrape, crawl or extract data from the Service by automated means, or circumvent query limits, rate limits or security measures;
- reverse engineer, copy or create derivative works of the Service, except as permitted by law;
- upload malicious code, interfere with the Service, or attempt to access other workspaces or accounts;
- create accounts in bulk or by automated means, or share accounts to avoid plan limits.
You are solely responsible for how you contact the businesses and people you find or store in the Service.
7. Google Maps data
The lead finder uses the Google Maps Platform. By using it you also agree to the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy. Business information comes from public listings maintained by Google and by the businesses themselves; we do not guarantee that it is complete, accurate or current. Classifications such as “no website” or “social media only” are automatic estimates based on that information.
8. Your content
You keep all rights to the data you add to the Service (“Your Content”). You grant us a limited license to host, store, process and display Your Content only as needed to provide, secure and support the Service. You are responsible for Your Content and for having the rights and legal basis to collect and use any personal data it contains. We handle Your Content as described in our Privacy Policy.
9. Our property
The Service, including its software, design, text, logos and the “Next Leads” name, belongs to Next Leads and is protected by intellectual property laws. These Terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription; they do not transfer any ownership. If you send us feedback or suggestions, we may use them without obligation to you.
10. Availability and changes
We work to keep the Service available and secure, but it may be interrupted for maintenance, updates or reasons beyond our control. We may add, change or remove features over time. If we remove a core feature of a paid plan, we will give reasonable notice.
11. Cancellation and termination
- You may stop using the Service and cancel your subscription at any time.
- We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that could harm us, other users or third parties. Where reasonable, we will notify you first and give you a chance to fix the issue.
- Before your account is closed, you can export your data to CSV inside the Service. After closure, we delete your data as described in our Privacy Policy.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee any number of leads, sales or business results. Financial features are management tools and do not replace professional accounting, tax or legal advice.
13. Limitation of liability
To the maximum extent permitted by law, Next Leads will not be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including rights you may have as a consumer.
14. Indemnification
You agree to indemnify Next Leads against claims, damages and costs (including reasonable legal fees) arising from Your Content, your use of the Service in violation of these Terms or of the law, or your contact with third parties found or stored through the Service.
15. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute will be resolved by the competent courts in Brazil, without prejudice to mandatory consumer protection rules that may grant you the right to bring a claim in your place of residence.
16. Changes to these terms
We may update these Terms from time to time. When changes are material, we will update the date at the top of this page and notify account owners by email or inside the Service at least 15 days before they take effect. If you continue to use the Service after that, you accept the updated Terms; if you do not agree, you may cancel your subscription.
